Contract & Sales Agreement (Puppy)
This contract is made and entered into this ______ day of _____________, to Alta King & Robert Warren of Eternal Flame Pit Bulls, here in after referred to as “seller”, and ___________________________________________, here in after referred to as “buyer”. The aforesaid parties mutually agree upon said puppy being of _________ registration, due to the breeding of __________________ (Sire) and _________________________ (dam), due/ born the month of ___________________. The buyer is to pay a down payment of $____________ for the assurance of said puppy, leaving a balance of $___________, due by __________________. Otherwise, if being bought outright, total purchase price of pup is $_____________ and due at this time.
Conditions of Sale
1. Both Buyer and Seller acknowledge that no representations, verbal or implied, have been made with regards to said dog’s future abilities (I.e. size, color, fertility, etc.), unless guaranteed by the breeder.
2. Seller warrants, to the best of his/ her ability, that said puppy is sound and free from all disease. At transfer, Seller guarantees this dog to be current on vaccinations and dewormings. Buyer has the option to take the puppy within 48 hours of purchase date, at their own expense, to a veterinarian of their choice. Seller does not accept responsibility for contagious disease diagnosed after 24 hours of possession in Buyer’s care. If the said puppy is found to have a life threatening illness before 12 months of age, seller will replace that puppy from the next available litter of equal quality and value. An adverse health report must be received in writing and signed by a licensed veterinarian, stating that the condition is LIFE THREATENING and UNTREATABLE, (excluding skin and coat problems). Any TREATABLE condition DOES NOT APPLY! If the condition in one that will go away, or is considered correctible, or a breed related minor condition, IS NOT covered. If the condition is one which the puppy will grow out of, it IS NOT covered!
*Please Note* a small list of treatable conditions- Giardia, Parvo, Demodectic Mange, Allergies, etc.
***Conditions which ARE covered- cleft palate, heart conditions that are NOT treatable, rickets, any congenital UNTREATABLE defect IS COVERED.***
3. It is to both Seller and Buyer to understand that all breeds are prone to certain health problems. The American Pit Bull Terrier is prone to Hip Dysplasia, Coronary problems, Demodectic Mange (Demodex), Grass Allergies (particularly in blue coated dogs), Brucellosis and Cruciate Ligament Tears. We as breeders are aware of these traits in the breed and try to the best of our knowledge to breed without these problems, but make it known to the buyer that this may or may not happen when buying a dog of this breed.
4. If said puppy is to be shipped, a health certificate will be provided and registration papers will be sent with the said puppy (if ground shipping) or shipped via certified mail (if shipped via air). Confirmation of delivery of the puppy and paperwork will be required.
5. Buyer certifies that he/ she is not acting as an agent for another individual in the purchase of said APBT puppy, and will not sell this puppy to any mass-producing kennel (puppy mill) or business. When purchasing a puppy from this Seller, Buyer agrees that the said puppy will not be used for any illegal purposes that violate the 1976 Animal Welfare Act. The puppy that the Buyer is purchasing will either be a pet, used for confirmation shows, weight pulling or boar hunting (if permitted by the state that Buyer currently resides). The Buyer fully understands and agrees that any mistreatment or fighting of any kind is punishable by law and at no point will the said APBT puppy or dog be introduced to such circumstances of any kind by the Buyer or anyone in relations to the Buyer. If there is evidence of the dog being abused or used in any illegal activity, we WILL confiscate the said APBT puppy or dog and take legal actions to the fullest extent, with no financial reimbursement to the Buyer!
6. The Buyer promises to keep the said puppy in a proper and humane manner. If problems arise in keeping or training, or the said puppy becomes seriously ill, the Buyer agrees to consult Seller. Adequate and responsible confinement will be provided by Seller to prevent escape, harassment by, theft or possible injury to the general community and in order to assist in the positive promotion of the Pit Bull breed and its responsible ownership. Buyer agrees to provide adequate food, water, shelter, exercise, health care, training and socialization to the said APBT puppy at all times. Enrollment into obedience training has been recommended to help the Buyer in understanding effective means of communicating with his/ her APBT. Proper training is a key element to responsible dog ownership especially when dealing with APBT’s. Participation in microchipping, and tattooing has been encouraged to help ensure return to the owner in the event said APBT becomes lost or stolen.
7. The Buyer agrees to provide updates to Seller on the health and well being of said APBT puppy and any changes to contact information (i.e.- phone number change, email address, home address change, etc.). The Seller asks that every so often the Buyer send recent pictures and a note stating news on the said APBT puppy. Seller recommends spaying and neutering to any dog that is to be used as a pet. Spaying and neutering greatly reduces many health conditions, such as infertility, birthing difficulty, offspring with birth defects, unwanted litters, monorchidism, propensity to fight, as well as escaping the yard to mate.
8. Seller does not give cash refunds for any reason! Refund/ replacement will not be the required due to sustained injury, environmental health exposure leading to illness, unlawful ownership, absence of proper training, heat stroke, carelessness, recklessness, neglect or abuse. Buyer agrees to pay any and all veterinarian charges and shipping charges. The registration papers must be returned to Seller before the pup will be replaced. If agreed return is made, upon examination, Seller has the right to maintain said APBT puppy in quarantine, at the expense of the Buyer for a period of two weeks. Buyer releases Seller, and their estate from any and all liabilities, and/ or damages by fault of said APBT puppy, at the time of sale. These damages include but are not limited to destruction of property and/ or physical damage to any animal, person or group of people. In the event that a breach occurs, and the breaching party, after notice, fails to remedy or cooperate, then this contract may be enforced in a court of law, the prevailing party shall then be entitled to be made whole and/ or to recover for damages, costs, and attorney fees, along with surrendering said APBT puppy back to Seller.
Shipping Agreements
If shipping is required, the charges, including crate, travel, and health certificate are to be calculated in writing ASAP and quoted to the Buyer in writing either by the Seller or shipping company. The shipping company we at Eternal Flame Pits uses, is All Aboard Pet Express, located near Fort Meyers, FL. All totals for shipping and said APBT puppy, are to be received in full by the time said puppy is 7 weeks old. The Buyer understands that the total fee for an 8 week old puppy will differ from that of an older puppy. Older puppies and adult dogs will be considerably more in shipping costs because of weight and larger crates are needed. Only puppies paid in full will be shipped. If, for some reason, the said APBT puppy is not paid in full by the 7th week and shipping is necessary, only a money transfer to another puppy from another litter of like value will be issued. NO REFUNDS WILL BE ISSUED!
*Special Note*
Because we love and cherish every puppy or dog we produce, we recommend to the Buyer that they come to pick up their puppy. We ARE NOT responsible for any puppies not picked up in a timely manner!
Down Payments/ Deposits
*Down payments are also referred to in this contract as the Surety of Action Deposit*
1. The Buyer agrees by sending in their first payment, this represents a full understanding and agreement to the mentioned conditions. Buyer will be required to sign and return this agreement by certified mail/ fax (if out of state or area). We will retain a copy for our records.
2. Unless specified above, down payments can only be transferred to another puppy from a litter of equal value. If chosen puppy from another litter is of greater value, the Buyer agrees to pay the complete difference after payment is applied.
3. It is the Buyer’s responsibility to make sure that the Seller has complete and accurate information to be able to contact Buyer regarding payments and updates on said puppy. Seller will not attempt to find Buyer if unable to locate the Buyer after any reasonable attempts have been made, according to the Seller; and at which point, Buyer’s requested puppy will be sold and Buyer WILL NOT receive any reimbursements regarding deposits or down payments put toward Buyer’s requested puppy. Buyer understands that this is a business agreement not to be infringed upon and is a true and legal binding contract.
Payments
The Seller will only accept the following payment types: Cash, Money Orders, Certified Checks or Western Union Payments. NO PERSONAL CHECKS WILL BE ACCEPTED! All puppies must be paid in full by 8 weeks of age (unless otherwise stated by the Seller), and if being shipped, puppies must be paid in full by the time they reach 7 weeks of age. Seller does suggest that all money be sent via certified mail, requiring a signature upon delivery if Buyer is unable to bring money in person. That will assure Buyer and Seller of no mistakes being made with deposits and payments. Please contact us for correct mailing address at: eternal_flame_pits@yahoo.com . This contract represents the entire agreement between the Buyer and Seller. No other agreements or promises, verbal or implied, are included unless specifically stated in writing. We know you will be pleased with your new American Pit Bull Terrier and we hope to keep putting Back Yard Breeders out of business by continuing to offer quality bred APBT’s to the public at working man prices!
*****This contract is made out in duplicate; the Seller and the Buyer both receive a signed copy for their records. The Buyer will receive the signed copy at the time of transfer-ship of said APBT puppy.*****
